Abstract

Spanish Abstract: El artículo examina si el derecho es una ficción y cuáles son las posibilidades de hacer ficciones. Se trabaja desde la perspectiva de la metafísica de Aristóteles, Tomás de Aquino y Leonardo Polo. Luego de una breve introducción (I), se define qué es ficción, cuáles son sus grados y límites (II). Con estas nociones se indaga si el derecho es una ficción fuerte y si caben las ficciones jurídicas débiles (III). Afirmado lo anterior, se estudia cómo se producen las ficciones jurídicas (IV), a fin de determinar cuáles son sus posibilidades y límites (V).

English Abstract: This paper analyzes whether the law is fiction and which possibilities could be of making legal fictions. We study it from the perspective of the Metaphysics of Aristotle, Thomas Aquinas and Leonardo Polo. After a brief introduction (Section I), we define what is fiction, what are their grades and limits (Section II). With these notions, we inquire whether the law is a strong fiction and whether weak legal fictions have any place in the law (Section III). Stated above, we study how legal fictions are generated (Section IV), in order to determine which possibilities and limits they have (Section V).
