Abstract

Romanian Abstract:Pe patru decembrie 2014, Uniunea Europeana a ratificat Conventia de la Haga asupra acordurilor de alegere a forului, încheiata la Haga, pe 30 iunie 2005, sub auspiciile Conferintei de Drept International Privat. În acest moment, conventia obligă următoarele subiecte de drept international public:S.U.A., Mexic și U.E..

Articolul de faţă își propune să studieze noul set de norme de privind alegerea forului introduse in Dreptul international privat romanesc prin tratat și să le compare cu dispozițiile articolelor 1066 și 1067 Cod procedura civila.

Convenția internațională precizează, în art. 2, sfera litigiilor civile cu element de extraneitate în care părțile pot încheia înțelegeri valabile de alegere a forului, litigii menţionate într-un mod mult prea general în primele alineate ale articolelor 1066 și 1067 Cod procedură civilă. În interesul simplificării reglementărilor românești de drept internațional privat și pentru armonizarea acestora cu normele din dreptul U.E. (atat din Regulamentul nr. 1215/2012 cât și din Convenția de la Haga din 2005) este necesar în opinia noastră să se modifice atât alineatul 3 al art. 1066 ( în sensul eliminării trimiterii către alin.1 al aceluiași articol) cât și alineatul 3 al art. 1067, ambele din Codul de procedura civilă, deoarece aceste aliniate, în actuala formă, sunt în contradicție cu prevederile art. 5 alin. 2 al Convenției.

Alegerea forului trebuie să respecte competența internațională exclusivă a instanțelor române dar și competența internațională exclusivă a instanțelor străine( potrivit articolelor 5 și 6 literele a, b și c din conventie si potrivit articolelor 1067 și 1081 Cod procedura civilă).

Convenția de la Haga din 2005 soluţionează şi conflictele de legi privind condițiile de validitate ale înțelegerii de alegere a forului. În vreme ce condițiile de formă sunt supuse normei materiale din art. 3 lit.c, condiţiile de fond sunt guvernate de legea statului forului ales ( Articolul, 5), cu excepţia capacităţii părţilor de încheia acordul. Aceastaeste guvernată atât de legea forului ales cât şi de legea statului forului derogat (Art. 6 literele a si b).

O soluţie comodă şi eficientă pentru legiuitorul român ar putea fi şi abrogarea articolelor 1066 şi 1067 Cod procedură civilă şi înlocuirea lor cu un articol de trimitere la Convenţia de la Haga din 2005.

English Abstract: On December 4, 2014, European Union ratified the Hague Convention of 2005 on Choice of Court Agreement, concluded at Hague on June 30, 2005 under the auspices of the Hague Conference on Private International Law. At this time, the convention binds three subjects of Public International Law: U.S.A., E.U and Mexico.

This paper analyses the new choice of court rules introduced in the Romanian Private International Law by the treaty and compares them with the provisions of Articles 1066 and 1067 Code of Civil Procedure. The treaty specifies, in Art. 2, the domain of civil litigations with international element where the parties can conclude valid agreements on choice of court. Thus, the treaty fills the gap created by the vague provisions on this subject of the first paragraphs of Articles 1066 and 1067 Code of Civil Procedure. In the interest of simplification of Romanian regulation of Private International Law and for the harmonization of these rules with the European Union it is mandatory to modify articles 1066 paragraphs 3 (by removing the reference to the first paragraph of the same article) and 1067 paragraph 3. That because these articles of law are inconsistent with the provisions of Article 5 paragraph 2 of the Convention.

The choice of court should observe the international exclusive jurisdiction of the Romanian courts as well as foreign exclusive international jurisdiction rules in accordance with Art. 5 and 6 of the convention and 1067 and 1081 of the Romanian Code of Civil Procedure.

The Hague Convention of 2005 answers the choice-of-law questions on the conditions of validity of the choice-of-court agreements. While the formal requirements of the agreements are subjected to the material rule of Article 3 letter c of the treaty, the substantial requirements are subjected to the law of the State where the chosen court is situated (Article 5 of the treaty) with the exception of the legal capacity of the parties to conclude such an agreement. This capacity is governed both by the law of the State of the chosen court and by the law of the State of the derogated court (Article 6 letters a and b).

A convenient and efficient solution for the Romanian legislator would be the repeal of Articles 1066 and 1067 Code of Civil procedure and to replace them with an article of law which would refer to the Hague Convention of 2005.
