Abstract
This Article explores the long and faltering history of attempts to impose liability on tobacco product manufactures. It traces the manufacturers' historical and ongoing targeting of youth through both promotions and deceptive advertising. It argues for an expanded cause of action against the manufacturers for the intentional tort of battery, and discusses the prospect of punitive damages awards.
