Abstract

This review discusses developments in New Zealand shipping law in 2000-2001. In particular, it analyses the adequacy of the Shipping Industry Review to inquire into the future of the New Zealand shipping industry. It also reviews case law developments on burden of proof in admiralty proceedings; the New Zealand Court of Appeal's approach to conflict of laws and ownership of foreign vessels; and two important New Zealand Court of Appeal decisions on the effects of forfeiture for fishing offences on the rights and liabilities of maritime owners and creditors.
