Abstract

This review discusses developments in New Zealand shipping law in 2004-2005. In particular, the review provides a critical evaluation of the Maritime Security Act, passed in response to concerns about maritime terrorism, and analyses legislative developments regarding maritime safety and the New Zealand Port and Harbour Marine Safety Code and Guidelines.The review also comments on case law decisions on carriage of goods, the relationship between the general civil and admiralty jurisdictions, the tensions between the fishing forfeiture regime and admiralty jurisdiction, and global limitation of liability for maritime claims.
