Abstract

This review discusses developments in New Zealand shipping law in 2006-2007. It focuses on, and critically evaluates the shortcomings of, the Ministry of Transport's 2007 draft strategy plan in Sea Change: Transforming Coastal Shipping in New Zealand. It also analyses important decisions on the application of global limitation of liability principles to maritime personal injury claims, the relationship between the Ship Registration Act, foreign registered ship mortgages and the Personal Property Securities Act, the application of New Zealand's strict limited liability domestic carriage regime to accidents in New Zealand ports, and the role of good faith in the "nautical fault" immunity in the Hague-Visby Rules.
