La legalidad administrativa en el umbral del Siglo XXI (The Administrative Law in the Threshold of the Twenty-First Century)

Abstract

Spanish Abstract: La historia demuestra que con el transcurso del tiempo la sociedad cambia su visión del mundo, sus valores básicos, su estructura política e social. El Estado de Derecho Moderno, por ejemplo, surgió de una reacción, que tuvo como marco histórico las dos revolución francesa del siglo XVIII.

En este sentido, el Estado tiene el poder de promulgar leyes de forma monopolística comienza a permitir también nuevas formas de control social basado en normas extralegales, es decir, las normas sin editar y controlado por el Estado. Un ejemplo de esto es el estándar moral o ética, o por el contrario, la autorregulación. Este artículo tiene como objetivo demostrar las tendencias socio-jurídico de principios de siglo, la realización de un paseo histórico, pasando por los institutos actuales.

English Abstract: History shows that over time society changes their world view, its basic values, its political and social structure. The modern state of law, for example, grew out of a reaction, which took as a historical frame the two French revolution of the eighteenth century. In this direction, the State that has the power to promulgate laws monopolistically, begins also to allow new forms of social control based on extralegal rules, that means, rules unedited or controlled by the state. An example of this is the moral law and ethical standard, or conversely, self-regulation. This article aims to demonstrate the socio-legal trends of the century, the realization of a historical walk, through the current institutes.
