Abstract

This paper reviews briefly the driver behind the establishment of the European Community, the evolution of the EC law in the achievement of its objectives, the scope and nature of 3 out of 4 core freedoms and their derogatory provisions, what it means in terms of residual sovereignty for member States and how legislation and case law have maintain the balance to achieve the European objectives. It concludes by critically appreciating the shortcomings, outstanding issues and other challenges.
