Abstract

תקציר בעברית: היחס בין אזרחות לנאמנות הולך ותופס מקום מרכזי בשיח הפוליטי בישראל בשנים האחרונות, המקבל ביטוי, בין היתר, בסדרה של הצעות חוק שמטרתן להתנות זכויות הכרוכות באופן מסורתי באזרחות בנאמנות למדינה. התפישה העומדת בבסיס חוקים אלו רואה באזרחות ובנאמנות את שני הנדבכים שעליהם מבוססת מערכת היחסים בין האזרח למדינתו. על פי תפישה זו, מושג הנאמנות מבטא את יחסו הנדרש של האזרח למדינה, קרי, חובותיו כלפיה, ואילו מושג האזרחות מבטא את זכויותיו של האזרח אל מול המדינה, קרי, חובותיה כלפיו.

הטענה כי אזרח חב בנאמנות למדינת אזרחותו מתקבלת בשיח הציבורי כמעט כאקסיומה. הדיון בתוכנה ומהותה של נאמנות זו, עם זאת, מועט. מאמר זה בוחן את מושג הנאמנות למדינה. המאמר מתמקד בשתי טענות מרכזיות. ראשית, המאמר טוען כי מושג הנאמנות למדינה הינו מושג עמום המבטא קשר רגשי נפשי למדינה וכי בשל טיבו ועמימותו, מקומו של המושג אינו בשדה המשפט. שנית, המאמר טוען כי נאמנות הינה מרכיב של הסולידריות החברתית וכי הדרת אזרחיה הפלסטינים של ישראל מסולידריות זו שומטת את הבסיס הלגיטימי לציפייה החברתית כי יחושו או יביעו נאמנות למדינה. המאמר טוען כי "מבחני נאמנות" לא נועדו ואינם מסוגלים להגן על אינטרסים חיוניים של המדינה או לחזק את הנאמנות אליה, וכי מבחנים מסוג זה מהווים בסיס לעקיפת איסור ההפליה הקבוע בחוק באמצעות התניית זכויות בדרישה הנתפסת, בטעות, כלגיטימית.

English Abstract: In recent years, the relationship between citizenship and loyalty has occupied an increasingly central place in the social and political discourse in Israel. This relationship is manifest, among others, a series of bills designed to make rights traditionally associated with citizenship contingent upon loyalty to the state. The concept underlying these laws regards citizenship and loyalty as the two pillars on which the relationship between the citizen and the state is based. According to this view, the concept of loyalty reflects the attitude required of citizens toward the state, that is, his obligations to the state, whereas the concept of citizenship reflects the rights of the citizen within the state, that is, the obligations of the state to him.

The argument that the citizen owes a duty of loyalty to the state of his citizenship is almost axiomatic. The debate concerning of the nature and essence of this loyalty, however, is scarce. The present article explores the concept of loyalty to the state. The article focuses on two principal arguments. First, the article argues that the concept of loyalty to the state is a vague one, which reflects a mental-emotional attachment to the state, and that because of its nature and vagueness, the concept is not a legal one. Second, the paper argues that loyalty is a component of social solidarity, and that the exclusion of Palestinian citizens of Israel from this solidarity removes the legitimate basis for the social expectation that they feel or express loyalty to the state. The article claims that "loyalty tests" are not intended to and unable to protect the vital interests of the state or to strengthen loyalty toward it, and that such tests are a basis for circumventing the legal prohibitions against discrimination by making rights contingent upon a demand that is mistakenly perceived as legitimate.
