Abstract

This paper reviews the Palmero Protocol and its provisions that address the root causes of human trafficking. In other words, it examines the transnational duties to prevent trafficking in persons by addressing the factors that make people vulnerable to exploitation in the first place. Tracing the history of this transnational obligation, this paper argues that there are unusually strong transnational obligations in the Palmero Protocol. Detailing the member state's shared legal responsibility to address root causes of trafficking, this paper advocates for greater political and scholarly attention to prevention measures.
