Legal Perspective of the Criminal Responsibility of Children: Contemporary Period

Abstract

The characteristic of the criminal responsibility of children in contemporary period of international law is a challenge to the global perception for children's rights. Criminal responsibility of children in the broadest sense can be considered in a unified or coherent body of international law. Different meanings of criminal responsibility have utility for various purposes and there is reason to decide upon one meaning as the right one. An important element in determining the criminal responsibility is identifying the age of the child. International law relating to children is best understood by considering at the outset what we mean and when we talk about childhood and children’s rights. The role of contemporary period of international law is significant in the history of science developments of criminal law particularly in the criminal responsibility of children in international law. The present study attempts to discover the legal perspective of international law in regard to the criminal responsibility of children as a prominent status of children's rights.
