GOLPE PARLAMENTAR DE 2016 NO BRASIL E O AFASTAMENTO DA PRESIDENTE: PODER JUDICIÁRIO COMO ULTIMA RATIO PARA SALVAGUARDAR A DEMOCRACIA (The 2016 Congressional Coup’ Etat in Brazil and President Removal: Judicial Branch as Ultima Ratio for the Protection of Democracy)

Abstract

Portuguese Abstract: O artigo trata de deposição Parlamentar da Presidente da República Federativa do Brasil e a competência do Supremo Tribunal Federal para elidir suas práticas, mediante o exercício de revisão judicial fundada na ética e nas normas Constitucionais. Critica-se a autocontenção do Supremo Tribunal Federal à revisão formal do procedimento de afastamento. Cogita-se que o referido Golpe de Estado possui características sui generis ao não se utilizar de Forças Militares. Conclui-se que o Poder Judiciário consubstancia a ultima ratio para salvaguardar a democracia e o sistema presidencialista conquistado pelo povo na Constituição de 1988.

English Abstract: The article deals with Parliamentary deposition of the President of the Federative Republic of Brazil and the competence of the Supreme Court to invalidate their practices, through the exercise of judicial review founded on ethics and constitutional norms. Criticizes the self-restraint of the Federal Supreme Court limiting its judicial review only to the formal removal procedure. In view of that, the Coup d'Etat has sui generis characteristics, it not employs military forces, conclude that the judiciary is the last course to safeguard democracy and the presidential system conquered by the people in the Constitution in operation since 1988.
