Can You Keep a (Trade) Secret? - The Pennsylvania Uniform Trade Secrets ActKurt M. SaundersCalifornia State University, Northridge July 2004 Abstract: Pennsylvania recently adopted the Uniform Trade Secrets Act. The Act provides the more specific legal standards as to trade secret protection for businesses by expanding the rights of trade secret owners as to the scope of protectable information, the amount of damages that may be recovered, and statute of limitations. The new statute also displaces the former common law of trade secrets and is intended to provide greater clarity and consistency on the issues of protection and misappropriation. This article provides an overview of the new law and insights as to its likely application and interpretation by the courts.
