The Impact of the European Company (SE) on Legal CultureMathias M. SiemsDurham University - Durham Law School; University of Cambridge - Centre for Business Research European Law Review, Vol. 30, pp. 431-442, 2005 Abstract: After 30 years of debate, the law on the European Company (Societas Europaea, SE) has now come into force. Yet, its success could be doubted, because the Regulation and the Directive on the SE provide only some basic provisions and refer frequently to the law of the Member States. In this article, I will, however, propose that the SE can cause a major shift towards a European spirit in company law. By fostering communication, competition and coalition, it will indeed have a substantial impact on European legal culture.
