Abstract

This is a draft of a column, published in the October 2005 issue of Trial Magazine. It concerns the Supreme Court's decision in Miller El v. Dretke (125 S.Ct. 2317). It supports Justice Breyer's sole concurrence, arguing that the only way to avoid Batson problems is to eliminate peremptory challenges altogether.
