The institutional role of the judiciary as manifested through the selection of Supreme Court judges (Από την απρόσωπη δικαιοσύνη στη δικαιοσύνη με πρόσωπο: η πλήρωση των κορυφαίων θέσεων των ανώτατων δικαστηρίων ως συνάρτηση του πολιτειακού ρόλου τής δικαστικής εξουσίας)

Abstract

Greek Abstract: Η μελέτη υποστηρίζει ότι το περιεχόμενο της έννοιας της δικαστικής ανεξαρτησίας – και, εντεύθεν, το εύρος και το βάθος των θεσμικών εγγυήσεων που τη θωρακίζουν – συναρτώνται με τον πολιτειακό ρόλο που επιτελεί η δικαιοσύνη στο εκάστοτε πολίτευμα. Πιο συγκεκριμένα, εξηγείται αρχικά ότι το περιεχόμενο των θεσμικών εγγυήσεων προϋποθέτει συγκεκριμένη αντίληψη για τον ρόλο τού εκάστοτε θεσμού στο πολιτειακό πλαίσιο: εν προκειμένω, ο τρόπος ανάδειξης της δικαστικής ηγεσίας μάς καλεί να εξεύρουμε πώς γίνεται αντιληπτός ο ρόλος τής δικαιοσύνης στη σύγχρονη θεσμική αρχιτεκτονική. Υποστηρίζεται ότι οι βασικές παράμετροι της λειτουργίας τής δικαιοσύνης, που αποδεικνύονται χρήσιμες για να προσδιοριστεί ο βέλτιστος τρόπος στελέχωσης της δικαστικής ηγεσίας, είναι η έκταση των αρμοδιοτήτων της και ο τρόπος ενάσκησής τους. Με τα δεδομένα αυτά, εξετάζεται η ιδιάζουσα θέση τής δικαιοσύνης στο ελληνικό πολίτευμα.

English Abstract: This study argues that the concept of judicial independence—and therefore the mechanisms employed to safeguard it—is contingent on the judicial function under the constitution. It explains that the interpretation of existing institutional checks and balances relies on a conception of the role entrusted to each institution under the constitutional framework. Therefore, a normative claim as to the method of selecting members of the judiciary requires an enquiry as to the function of the judiciary under the constitution. It is submitted that the principal parametres by which the function of the judiciary should be ascertained are the extent of the competence of the judiciary, as well as the exercise of such competence. Against this framework, the paper examines the function of the judiciary under the Greek constitution.
