Legea penală şi limitele ei de aplicare din perspectiva noului Cod penal şi a Codului penal anterior (Criminal Law and Its Limits of Application From the Perspective of the New Criminal Code and the Previous Criminal Code)

Abstract

Romanian Abstract: Partea centrală a acestui studiu este dedicată revizuirii comparative a dispozițiilor din titlul I ("Legea penală și limitele domeniului său de aplicare") din Codul penal în 2009 în comparație cu prevederile titlului I ("Legea penală și Limitările sale de Domeniul de aplicare ") din Codul penal în 1969, autorul subliniind atît meritele, cît și neajunsurile noului Cod Penal, explicații însoțite de numeroase exemple, idei proprii și sugestii de a imprumuta textele examinate. Aceste explicații sunt însoțite de o analiză riguroasă a dispozițiilor referitoare la implementarea în timp a legii penale, menționată în Titlul I al Legii nr. 187/2012 pentru implementarea Legii nr. 289/2009 privind Codul penal. Într-o secțiune finală, autorul își prezintă propriile constatări învățate în legătură cu chestiunea investigată în care se adaugă, într-o formă sintetică, principalele propuneri de lege ferenda care vizează îmbunătățirea noii legislații penale.

English Abstract: The central part of this study is dedicated to the comparative review of the provisions in Title I („The Criminal Law and the Limits of its Scope”) of the Criminal Cod in 2009 as compared with the provisions of Title I („The Criminal Law and its Scope Limitations”) of the Criminal Code in 1969, the author highlighting both the merits and the shortfalls of the new Criminal Code, explanations accompanied by numerous examples, own ideas and suggestions to impruve the texts under review. This explanations are accompanied by a thorugh analysis of the provisions relating to the implementations in time of the criminal law, referred to in Title I of Law no. 187/2012 for implementing Law no. 289/2009 on the Criminal Code. In a final section, the author puts forth his own findings learned in connection with the matter investigated to witch are added, in a synthetic form, the main proposals de lege ferenda aiming to improve the new criminal legislation.
