PROFANAREA DE CADAVRE SAU MORMINTE ÎN CONCEPŢIA NOULUI COD PENAL (Desecration of Bodies or Graves in the New Criminal Code)

Abstract

Romanian Abstract: Articolul se referă la infracțiunea de profanare a cadavrelor sau a mormintelor în proiectarea noului Cod Penal Român. Autorul analizează în mod critic prevederile noului Cod Penal în legătură cu legea penală anterioară. În acest context, sunt prezentate subiecte legate de conceptul și caracterizarea infracțiunii, elementele preexistente, structura și conținutul juridic al infracțiunii, forme, modalități și sancțiuni, legătura cu alte infracțiuni, aspecte procedurale, legislație anterioară și situații tranzitorii și de asemenea, aspecte ale dreptului comparat.

English Abstract: Article approaches the offence of profanation of dead bodies or graves in the design of the new Romanian Penal Code. The author critically analyzes the provisions of the new Penal Code in relation to previous Penal Law. In this context, are presented topics related to the concept and characterization of the offence, pre-existing items, structure and legal content of the offence, forms, modalities and penalties, link to other offences, procedural aspects, previous legislation and transitory situations and also issues of comparative law.
