El poder constitucional en América Latina: hacia una tipología de las cortes constitucionales de la región (The Constitutional Power in Latin America: Towards a Typology of the Constitutional Courts of the Region)

Spanish Abstract: Los tipos de cortes constitucionales que existen en América Latina vienen dados por las variaciones institucionales en los poderes que tienen estas cortes. De un lado, sus atribucio¬nes como árbitros de la política, en donde pue¬den alterar la estabilidad política y controlar a las autoridades del Estado; de otro, el poder de protección de derechos ciudadanos, materiali¬zado a través de la judicialización de la política. Tomando como referente empírico siete países de la región que tienen cortes constitucionales autónomas, se construye una tipología en don¬de interaccionan las dos variables. Colombia y Ecuador aparecen como referentes de cortes imperiales, mientras que Guatemala y Chile quedan rezagadas en su dotación de poderes formales. Los hallazgos dan cuenta que en la región existe un fortalecimiento de los pode¬res de protección ciudadana de las cortes, en desmedro de sus poderes políticos.

English Abstract: This article seeks to determine what types of Constitutional Courts exist in Latin America. In response, I argue that these types are given by institutional variations in the powers that these courts have. On the one hand, its attributions as referees of politics, where they can alter political stability and control the State authorities. On the other, the power to protect citizen rights, materialized through the judicialization of politics. Taking seven countries of the region that have autonomous Constitutional Courts as empirical reference, I build a typology in which the two variables interact. Colombia and Ecuador appear as referents of Imperial Courts, while Guatemala and Chile are left behind in their endowment of formal powers. The findings show that there is a strengthening of citizen protection powers of the region’s courts, to the detriment of their political powers.
