Abstract
German Abstract: Betrachtet man Nord- und Südpol, Arktis und Gegen-Arktis (Antarktis), näher, unter-scheiden sie sich nicht nur in Bezug auf die klimatischen Bedingungen und die Auswir-kungen, die Umweltgefahren auf sie haben, sondern vor allem durch die völkerrechtli-chen Regeln und Regime, die diese Gebiete normieren. Ein Grund ist die geographische Lage, durch die die Antarktis weit mehr staatlichem Einfluss entrückt ist als die Arktis. Die Unterschiede erklären sich aber auch durch die historischen Entwicklungen, die es möglich gemacht haben, dass die Vertragsstaaten im Bereich der Antarktis trotz aller gegensätzlichen Interessen seit den 1950er Jahren bis heute ein umfassendes und moder-nes, wenn auch nicht lückenloses völkerrechtliches Regime zum Schutz der Umwelt entwickeln konnten. Die Umwelt beider Pole ist besonders vulnerabel und zugleich für die Umwelt der gesamten Erde von großer Bedeutung. Umso mehr soll der Blick im Folgenden darauf gerichtet werden, was bereits völkerrechtlich zum Schutz der Umwelt in der Antarktis und Arktis erreicht wurde und welche Gefahren und Probleme weiterhin bestehen, denen in Zukunft mit Hilfe des Völkerrechts begegnet werden sollte.
English Abstract: When examining the North and South Pole, the Arctic and Antarctica more closely, they do not only differ in climatic conditions or the consequences of environmental dangers, but especially in the rules and regime of international law through which they are governed. One reason is the geographic location placing Antarctica at a greater distance from state influence than the Arctic. Another reason for the differences are the historical developments in the Antarctica area. Since the 1950s, these developments have enabled the state parties to develop, despite all opposing interests, a comprehensive and modern, yet not gapless international law regime for environmental protection. The environment of both Poles is especially vulnerable and at the same time of great importance to the entire globe. All the more, the following analysis is focused on what international law has already achieved for the protection of the environment in the Arctic and Antarctica as well as which dangers and problems still prevail and shall be addressed by international law in the future.
