Abstract

Portuguese Abstract: Este trabalho objetiva traçar linhas gerais sobre a responsabilidade civil diante das práticas discriminatórias de geoblocking e geopricing no direito brasileiro. Pelo método indutivo de abordagem, busca-se aproximar o leitor ao debate sobre o relacionamento entre direito e inovação, apresenta-lo a uma possível definição técnica e refletir sobre o tratamento do assunto diante da legislação do país. Conclui-se que, apesar da urgência de se regular expressamente o tema, existem elementos normativos mínimos capazes de informar a análise de eventuais casos concretos.

English Abstract: This article seeks to present some thoughts about the discriminatory practices of geoblocking and geopricing in Iight of the Brazilian law of torts. Using an inductive approach, we sought to introduce the reader to the debate regarding the relationship between law and innovation, show him a possible technical definition and reflect about the handling of the subject before the country’s legislation. We conclude that, despite the urgent need for express regulation of the topic, there are currently enough normative elements to be able to assess eventual concrete cases.
