Spanish Abstract: El “abuso de procesos legales” fue una de las principales novedades de la Ley de Represión de Conductas Anticompetitivas. Sin embargo, la jurisprudencia reciente de la Sala de Defensa de la Competencia 1 del Tribunal de Indecopi ha limitado su aplicación de manera tal que la figura ha quedado prácticamente vaciada de contenido. El presente artículo desarrolla los incentivos económicos de la llamada “litigación predatoria”, sus orígenes y los objetivos de su represión, aspectos que no fueron debidamente valorados por la instancia máxima del Indecopi.

English Abstract: The “abuse of legal processes” was one of the main novelties of the Repression of Anti-competitive Conducts Law. However, the recent jurisprudence of the First Competition Court of the Indecopi has limited its application in such a way that the figure has been practically emptied of content. This article elaborates on the economic incentives of the so-called “predatory litigation,” its origins, and the objectives of its repression, aspects that were not duly valued by the highest level of Indecopi.
