O caso da Boate Kiss no Sistema Interamericano de Direitos Humanos: o (des)cabimento de medida cautelar pela CIDH (The Kiss Nightclub Case in The Inter-American Human Rights System: the (In)Viability of Precautionary Measures by the IACHR)

Abstract

Portuguese Abstract: O artigo versa sobre o acesso às medidas cautelares da Comissão Interamericana de Direitos Humanos (CIDH) e, a partir do “caso da Boate Kiss”, em referência ao incêndio que vitimou mais de 200 pessoas na cidade de Santa Maria/RS, problematiza o tema da execução imediata da pena nos casos de condenação proferida em tribunal do júri. Por meio de abordagem jurídico-prospectiva, o artigo detalha o procedimento cautelar perante a CIDH, menciona os pressupostos e requisitos para as medidas outorgadas pela Comissão e diferencia os procedimentos da Comissão daqueles realizados perante a Corte Interamericana de Direitos Humanos (Corte IDH). Discute a possibilidade de acesso ao sistema regional de proteção dos direitos humanos a partir da suspensão de liminar, determinada pela presidência do Supremo Tribunal Federal, que resultou no recolhimento à prisão dos condenados no caso da Boate Kiss (STF, SL 1504 MC/RS). Ao final, conjectura sobre a discussão no STF a respeito da validade constitucional do art. 492 do CPP pela Lei 13.964/2019 (Pacote Anticrime), que determina, como regra, o cumprimento imediato da pena nas condenações de júri a pena igual ou superior a 15 anos.

English Abstract: The paper analyses the access to precautionary measures issued by the Inter-American Commission on Human Rights (IACHR) and, based on the “Kiss Nightclub case”, referring to the fire that killed more than 200 people in the city of Santa Maria, Rio Grande do Sul, discusses the immediate execution of the conviction by jury trials. Through a legal and prospective approach, the paper details the precautionary procedure in the IACHR, mentions the assumptions and requirements for the measures granted by the Commission and differentiates the Commission's procedures from those carried out before the Inter-American Court of Human Rights (Inter-American Court of Human Rights). It discusses the possibility of access to the regional system of human rights protection after the suspension of the injunction, determined by the President of the Brazilian Supreme Court, which resulted in the imprisonment of those convicted in the Kiss Nightclub case (STF, SL 1504 MC/RS). Finally, it conjectures on the discussion in the Supreme Court regarding the constitutional validity of art. 492 from Criminal Procedure Code as established by the Federal Act 13.964/2019 (Anti-crime Package), which determines, in general, the immediate execution of jury trials convictions when sentencing is equal to or larger than 15 years.
