Abstract
This study for the European Parliament Policy Department examines the regulation for a European Health Data Space (EHDS), proposed by the European Commission in May 2022. The EHDS introduces mandatory rules for electronic health record to facilitate user access and portability of personal health data (primary use) and pooling of health data for research and policy purposes (secondary use), within and between EU Member States. The study discusses the legal and economic challenges to implement the proposed EHDS, including costs and incentives for health care providers and the interaction between EU and Member State level institutions. It recommends a number of improvements in the design of the EHDS.
