Abstract

Dutch Abstract: Op 1 oktober 2003 trad de Wet Internationale Misdrijven (WIM) in Nederland werking. De belangrijkste doelstelling van de wet was om aan de verplichtingen te voldoen, voortvloeiende uit de ratificatie door Nederland van het verdrag van Rome met betrekking tot de oprichting van het Internationale Strafhof. Daarnaast wilde Nederland zich met een actieve vervolging van oorlogsmisdadigers graag verder profileren als een staat die zich actief inzet in de strijd tegen de straffeloosheid van deze daders en verder gaan dan alleen als gastland van het internationale straftribunaal voor voormalig Joegoslavië en het Internationale Strafhof te dienen. Maar wat heeft 10 jaar WIM tot dusverre opgeleverd? In deze bijdrage zal het functioneren van de WIM en de vervolging van oorlogsmisdadigers en andere verdachten van internationale misdrijven in Nederland nader worden belicht.

English Abstract: On October 1, 2003 the Dutch international crimes act (Wet International Misdrijven) became operation. The main aim of the act was to fulfill the Dutch obligation resulting from the ratification of the Rome Statute and to show the world that apart from hosting institutions like the ICTY, the ICC and the ICJ, the Dutch authorities would actively prosecute war criminals themselves. In this paper it is evaluated to what extent the Dutch national authorities have effective prosecuted war criminals.It is shown that the Dutch authorities have prosecuted nine cases with 13 suspects. Seven out of these nine cases have became final. Six suspects have been convicted and one suspect was acquitted. Compared to the ICC, which has convicted two suspects and acquitted one in the past ten years, the Dutch authorities are thus doing a pretty good job.
