Abstract

The authors present a comparative analysis of the institutions of the criminal responsibility of the notaries in the legislations of Russia and Germany. The article examines the issues of criminal-legal status of the notary in Russia and in Germany, gives the different approaches of German and Russian criminal law doctrine to the criminal prosecution of a notary for different actions. The general characteristics of the criminal liability of notaries are identified; effectiveness of the implementation of the relevant provisions of the criminal law in these states is evaluated.
