Abstract
Portuguese Abstract: O presente trabalho analisa os contextos históricos e normativos da participação popular no Direito Ambiental brasileiro, tendo como ponto de partida a opressão e violência decorrentes do recorte histórico e crítico da colonização do Brasil. O objetivo principal é reconstruir o panorama aproximado da participação e da cidadania na cultura pós-colonial atual, reconhecendo o valor e imenso desafio de concretização do ideal republicano de emancipação pessoal e política. Busca-se avaliar criticamente os principais fundamentos e mecanismos da participação no Direito Ambiental brasileiro. Utilizando-se do método dedutivo e pesquisa bibliográfica, o estudo adota como referencial teórico as obras de Enrique Dussel e Paulo Freire. Demonstra-se que não basta a mera previsão legal de mecanismos de participação popular na gestão ambiental para que estes sejam efetivos. É necessário um salto qualitativo em duas áreas essenciais: a ética e a educação. Apenas com um processo contínuo de conscientização possibilitará alcançar os objetivos dos mecanismos de participação popular.
English Abstract: This paper analyzes the historical and normative contexts of public participation in the Brazilian Environmental Law, taking as a starting point the oppression and violence resulting from the historical and critical profile of the colonization of Brazil. The main objective is to reconstruct the panorama of participation and citizenship in the current post-colonial culture, recognizing the value and immense challenge of realizing the republican ideal of personal and political emancipation. It seeks to critically assess the main fundamentals and mechanisms of participation in Brazilian Environmental Law. Using the deductive method and bibliographic research, the study adopts the works of Enrique Dussel and Paulo Freire as a theoretical reference. It is demonstrated that the mere legal provision of mechanisms for popular participation in environmental management is not enough for them to be effective. A qualitative leap is needed in two essential areas: ethics and education. Only with a continuous process of awareness it will be possible to achieve the objectives of the mechanisms of public participation.
