Abstract

Article 181(5) of Ghana’s 1992 Constitution requires parliamentary approval of international business transactions to which the government is party, a term defined to include state procurement contracts and various public-private investment projects. This paper traces the origin of that constitutional requirement. It reviews the Supreme Court’s case law on the subject and discusses their implications for Ghana’s relationship with the international business community. It concludes with suggestions for legislative intervention.
