Abstract
Russian Abstract: Работа посвящена анализу положений статьи 451 Гражданского кодекса России, устанавливающей в российском праве принцип clausula rebus sic stantibus и позволяющей изменять или расторгать договоры в случае существенного изменения обстановки. В статье анализируется исторический и сравнительно-правовой аспект этой доктрины, а также анализируется связь принципа clausula rebus с принципом объективной добросовестности.
English Abstract: The article is devoted to the provisions of Article 451 of the Russian Civil Code, with establishs the clausula rebus sic stantibus rule in Russian private law. Article 451 of the Code allows the party to a contract to bring a lawsuit in order to rescind a contract or to change it's provisions because of the uncontemplated change of circumstances. The authors made historical and comparative observations of the roots of clausula rebus rule, and examined it's connection with good faith principle.
