Abstract

The infringement procedure is an important tool for forcing a Member State to be in line with EU law. One of the frequent infringements committed by Member States is a wrong or belated implementation of directives. Implemented directives cover significant part of national law, such as public procurement or consumer protection. The Lisbon Treaty introduced a possibility for a shorten procedure in Article 260(3) TFEU. This possibility was recently interpreted and applied for the first time in the case C-543/17 Commission v Belgium. This contribution analyses the case and it explores the possible impact that the speed-up procedure may have on the implementation of directives.
