Abstract
Spanish Abstract: Este trabajo comenta el caso recogido en su título, uno de los que ha atraído mayor interés y está
llamado a influir más intensamente en el sector de asistencia judicial internacional correspondiente
al sistema de los Estados Unidos. Tras un Apartado introductorio, se lleva a cabo en el siguiente una
presentación minuciosa de la Ponencia del Juez Hall, en la que concurren los otros dos miembros de
su prestigiosa sede judicial. Luego, en el Apartado tercero se analizan las dos aportaciones
principales de la correspondiente Decisión, centradas en la competencia jurisdiccional personal y la
llamada extraterritorial discovery, respectivamente. El estudio concluye en el Apartado cuarto con
un triple plano de reflexiones, que comprenden desde el influjo en el caso de célebres precedentes
en materia de derechos humanos hasta el impacto que está teniendo en los medios profesionales y lo
necesario de que, desde una perspectiva española, se haga un seguimiento estrecho de éstos y
similares desarrollos del sistema citado.
English Abstract:This paper discusses the case named in its title, one of which has attracted the most interest and is called to influence more intensely the sector of international legal assistance of the United States system. Following an introductory section, a detailed presentation of Judge Hall’s exposition is carried out in the next one, with which the other two members of this prestigious judicial body concur. Then, in the third section, the two main contributions of this decision are analyzed, which focus on personal jurisdictional competence and the so-called extraterritorial discovery, respectively. The study concludes in the fourth section with a threefold level of reflections, ranging from the influence on the case of well-known human rights precedents to the impact it is having on professional circles and how necessary it is, from a Spanish viewpoint, to closely monitor these and similar developments of the aforementioned system.
