Hush Little Lady Don’t Say a Word: How Charging Rape Victims With False Reporting in Lieu of Proper Investigation Techniques Is the Improper Application of the Law

Abstract

Imagine being raped and having the courage to come forward and recount the horrific details of your assault with anticipation that your attacker will be prosecuted. However ,this does not happen, instead, you, the rape victim is charged with false reporting. Charging victims of sexual assault is an additional traumatic violation. This article examines this global issue and looks into methods to eradicate this problem , by proposing the adoption of guidelines to assist with and ensure proper investigative techniques, and suggesting Louisiana specific statutory language to amend existing statutes governing false reporting. In so doing, attackers can be brought to justice and sexual assault victims will not have to be called liars through false reporting charges.
