Abstract
Portuguese abstract: Os direitos humanos são tema da pauta hodierna e devem guiar as ações dos Estados no trato com os seus presos, independentemente da nacionalidade, garantindo o mínimo existencial a essa parcela da população. Nesse sentido, a possibilidade de ressocialização dos apenados decorre da expansão protetiva e da afirmação dos direitos humanos. Contudo, a ressocialização dos presos estrangeiros pode ser dificultosa, considerando diversos fatores como diferença linguística, cultural e moral, etc.
English abstract: Human rights are the issue of the current agenda and should guide the States' actions in their relationship with prisoners, independently of nationality, ensuring the minimum existential for them. Thus, the possibility of rehabilitation of prisoners arises from the protective expansion and affirmation of human rights. However, the rehabilitation of foreign prisoners can be troublesome, considering various factors such as linguistic, cultural and moral difference, among others.
