Abstract
Russian Abstract: В статье показано, что запланированные программой «Цифровая экономика» мероприятия по нормативному регулированию цифровой среды непосредственно связаны со сферой управления документацией. Особое значение это имеет для органов управления, поскольку от их реализации во многом зависит эффективность взаимодействия государства, бизнеса и гражданского общества. Констатируется дефицит нормативных документов на государственном уровне, регламентирующих процессы управления документацией в условиях цифровизации. Это приводит к тому, что имеющиеся правовые лакуны органы власти заполняют самостоятельно в соответствии со сложившейся практикой в локальных правовых актах, что не обеспечивает унифицированного подхода. В статье обозначена необходимость дальнейшего совершенствования терминологического аппарата и его адекватного использования в нормативных правовых актах, осуществления разработки унифицированных систем документации в соответствии с регламентированной процедурой. Приводятся примеры правовых ограничений, препятствующих переходу на безбумажное взаимодействие. В частности, высказываются предложения по модернизации форм и методов работы органов власти с обращениями граждан. Формулируется вывод о том, что цифровые технологии должны явиться тем инструментом, с помощью которого определяется маршрут движения обращения на соответствующий уровень в зависимости от его содержания, становится «прозрачным» для гражданина весь процесс его рассмотрения. Одновременно с этим обозначены риски по созданию нормативных правовых актов органов исполнительной власти в форме электронного документа.
English Abstract: The article shows that the measures planned by the Digital Economy program for normative regulation of the digital environment are directly related to the sphere of documentation management. This is of particular importance for governing bodies, since the effectiveness of interaction between the state, business and civil society largely depends on their implementation. The deficit of regulatory documents at the state level governing the processes of document management in digitalization is noted. This leads to the fact that the authorities fill in the existing legal gaps independently in accordance with established practice in local legal acts, which does not provide a unified approach. The article outlines the need for further improvement of the terminological apparatus and its adequate use in regulatory legal acts, the implementation of the development of unified documentation systems in accordance with the regulated procedure. Examples of legal restrictions that impede the transition to paperless interaction are given. In particular, suggestions are made for the modernization of forms and methods of work of authorities with citizens' appeals. The conclusion is made that digital technologies should be the tool with which the route of circulation of the appeal to the appropriate level is determined depending on its content, the whole process of its consideration becomes “transparent” for the citizen. At the same time, risks are identified for the creation of regulatory legal acts of executive authorities in the form of an electronic document.
