Abstract
Spanish Abstract: Las obligaciones pecuniarias, entendidas como aquellas que tienen por objeto el pago de una cierta suma de dinero, son las más difundidas en la experiencia jurídica y merecieron singular atención por parte de nuestro legislador, quien dictó normas especia-les para su regulación en el Código Civil boliviano vigente desde 1976.
El presente trabajo aborda una cuestión importante como es la responsabilidad del deudor por el retraso en el cumplimiento de las obligaciones pecuniarias, precisando el verdadero sentido y alcance de los preceptos que regulan la reparación del daño sufrido por el acreedor y desentrañando el origen del dinero, el principio nominalista, los intereses, la mora del deudor, el daño patrimonial automático y otras cuestiones centrales del Derecho Civil.
English Abstract: The pecuniary obligations, understood as those that has as its object the payment of a sum of money, are the most spread in the legal experience and they deserved singular attention from our legislator, who issued special rules for its regulation in the Bolivian Civil Code in force since 1976.
This work addresses an important topic as it is the debtor liability for the delay in performance of the pecuniary obligations, specifying the meaning and scope of the rules that regulate the repair of the damage suffered by the creditor and unraveling the origin of money, the nominalist principle, the interests, debtor’s default, the automatic patrimonial damage and other central questions of the Civil Law.
