Contribution of the Indian Judiciary to Healthcare in India

Abstract

The healthcare system in India is one of the weakest links of our development model. The financial and infrastructure resources allocated to the public health sector has been dismal and has not improved over time. Consequently, the Indian judiciary has had to step in to protect and promote the right to health of the people. While the judiciary has contributed significantly across the horizon of medical and health care, the author seeks to showcase the courts’ contribution in three critical areas namely: emergency medicine, which is fraught with ethical and legal questions, mental health, which is neglected by the State and the society and reproductive rights, an area in which law is yet to strike a perfect balance between the interests of the State and individual rights.
