Changing the Opt-Out Tradition in the United States

Abstract
This brief piece derives from a talk given at a Congress to celebrate the fortieth annual session of the United Nations Commission on International Trade Law (UNCITRAL), held at UNCITRAL’s headquarters in Vienna in July 2007. It is posted on the UNCITRAL website. It discusses reasons for the U.S. legal community’s resistance to having the United Nations Convention on Contracts for the International Sales of Goods (“CISG”) govern international sales transactions, and it identifies forces that are slowly eroding those reasons.
