Abstract

Filed on behalf of three conservation organizations in Monsanto v. Geertson Seed Farms, this brief seeks to inform the United States Supreme Court about the remedies available in NEPA cases under the Administrative Procedure Act, and how that context shapes the discretion of federal district courts to provide different forms of relief to remedy a NEPA violation consistent with the statute. Additionally, the brief analyzes the statutory scheme and purpose embodied in NEPA in explaining that localized and regionalized environmental impacts can serve as the basis for irreparable injury warranting injunctive relief under NEPA, irrespective of whether the unlawful conduct will cause nationwide or worldwide environmental harm.
