Abstract

The paper analyzes a case in which the judicial debate was centered in whether the carriage and use of coca leaves was licit or not and whose resolution acquitted two Bolivian citizens of Quechuan origin from the charges of illicit traffic of narcotics, applying in analogy in bonam partem a norm of the Indigenous Law, in spite of the nationality of the accused, leaning implicitly and thoughtlessly on the Declaration of United Nations about Rights of the Indigenous people. At the same time, the judgment that rejected the given action for notice for appeal by the Public Ministry applied article 27 of the International Pact of Civil and Political Rights.
