Abstract

The new Penal Code Bill in Chile initiated a public and parliamentary debate regarding which social conflicts should be punished and which should be excluded from the criminal system. The struggle to impose a particular discourse on criminality is a critical issue under the current criminal-political setting. This paper discusses the discriminatory liberal criminal model which, on the one hand, legitimizes the enforcement of the criminal system over underprivileged classes and on the other, displaces specific social conflicts by means of the powerful classes’ exclusion discourse
