Abstract

This article is a survey of developments in evidence rules in 2001-2002. This issue covers Procedure, Relevancy, Witnesses, Cross-examination and Impeachment, and Hearsay.

Procedure includes: Preservation, Harmless Error, Res Ipsa Loquitur, and Reopening of a Party's Case.

Relevancy includes: General considerations, Other Crimes, Habit, and Demonstrative and Real Evidence.

Witnesses includes: A Calling of Witnesses by the Court, Rebuttal Witnesses, and Confrontation.

Cross-examination and Impeachment includes: Prior Convictions, Prior Inconsistent Statement, Perception, Religious Belief, and Prior Consistent Statements.

Hearsay includes: Speaking Agent, Present Sense Impression, Excited Utterance, State of Mind, Statement of Physical Condition, and Business Records.
