Abstract

The paper starts with a survey of the current European and U.S. patent practice with regard to human stem cell technology. The paper then offers an overview of the current European patent framework for human stem cells and critically examines the recommendations put forward in the Opinion of the European Group on Ethics in Science and New Technologies Opinion. Finally, there is an examination of the critical relationship between patent law and research. In doing so, attention is paid to the indirect and direct effects of patents on research.
