Abstract

Violence against women and fear of violence continue to pose challenges for the justice system, especially when cultural factors are enlivened. The rights to security of person and freedom from fear require recognition in human rights discourse. There can be no compromise about the criminalisation of physical violence. However, difficulties may arise when the policies underlying the laws reflecting the majority culture conflict with other policies involving the recognition and respect of minority cultures. These tensions raise complex issues.
