Abstract

This paper argues that the Green Paper on European Contract Law contains only two real options. The first and most likely one - advocated by Lord Mance - is to do nothing. This would not mean that the DCFR will have no value: it will serve as a catalyst for comparative law and a default rule for legislators. The second and preferable option - maintained by many academics - is the Blue Button approach. And yes, of course the instrument should cover b2b contracts, both cross-border and internal transactions, and for the time being may be limited to the general part of contract law and sales law.
