'Judicial Politics': Restoring the Michigan Supreme Court

Abstract

The Michigan Supreme Court has developed an unfortunate reputation nationally for reversing its own precedents based on political majorities on the court. That reputation undermines public confidence in the judiciary. The court should avoid statements in its opinions that highlight the shifting political majorities and should take other specific steps to rebuild public confidence in the integrity and stability of its decisions.
