Abstract
This commentary, in French, analyses the early case law of the ICC in relation to provisional release under the conditions of Article 60 of the Rome Statute. It establishes that despite the best intentions of the ICC in applying the human rights principle that liberty is the rule and detention the exception, the judges of the ICC have shown a willingness to interpret the Statute in a way that negates these good intention. Beyond that, the commentary shows that the provision and the difficulties in its application is the result of sloppiness in the drafting. Indeed, reference to the conditions of issuance of an arrest warrant, especially the existence of reasonable grounds to believe that the person has committed a crime within the jurisdiction of the Court, should never have been made in relation to the decision to grant provisional release or not.
