Abstract

Critiques the development under the Human Rights Act 1998 of the so-called 'Mirror Principle' under which domestic protections for rights under the Act should replicate those protections afforded by the European Court of Human Rights. Examines the pros and cons of such an approach, and the adequacy of the mirror metaphor as a tool of judicial reasoning.
