Abstract

Romanian Abstract: Curtea de Justiţie a Uniunii Europene („CJUE”) este chemată să asigure respectarea dreptului în interpretarea şi aplicarea tratatelor Uniunii Europene. Are oare CJUE vreo misiune de îndeplinit în raport cu aspectul aparent presant al simplificării legislaţiei Uniunii Europene şi al reducerii sarcinii administrative? Articolul de faţă tratează câteva probleme ale acestui domeniu vast, având ca punct de plecare principiul echilibrului instituţional între CJUE şi legiuitorul Uniunii Europene. Sunt examinate câteva exemple recente din jurisprudenţa CJUE.

English Abstract: The Court of Justice of the European Union (“CJEU”) is called to ensure that in the interpretation and application of the Treaties of the European Union the law is observed. Does the CJEU have a mission to accomplish towards the apparently pressing topic of simplification of EU legislation and burden reduction? The following paper strives to discuss few issues of this vast field having as a starting point the principle of institutional balance between the CJEU and the EU legislator. Some recent examples from the CJEU’s case law will be considered.
