Abstract

Chinese Abstract: 作为全球能源治理领域最重要的多边条约机制之一,能源宪章正在推进以结构转型和制度升级为两条生命线的“现代化路线图”。 2015年5月新的《国际能源宪章》国际能源宪章的签署标志着能源宪章迈入了2.0时代。能源宪章体系的现状与发展方向与我国“一带一路”建设规划不谋而合,能源宪章改革的“领袖缺位”困境 为中国参与亚欧乃至全球能源治理体系提供了战略机遇。中国加入能源宪章体系的经济成本较低、法律成本和政治成本有限,但具有较大的经济收益、明显的法律收益和政治收益。中国应积极参与能源宪章的改革并推动其升级改造,在此基础上认真考虑签署《能源宪章条约》,以确保我国在国际能源合作中的利益诉求,维护国际能源安全,进一步深度参与国际能源治理。

English Abstract: The signing of the new International Energy Charter symbolizes the start of "Version 2.0" of the Energy Charter as one of the most important multilateral treaty regime in global energy governance, which is undergoing a process of modernisation emphasising an expansion of its geographic reach and upgrading of its rules and system at the same time. The current and potential geographical coverage and the proposed reforms of Energy Charter coincide with China’s recently launched "One Belt One Road” Initiative in terms of both geographic reach and directions of reform. The modernisation of Energy Charter process and the absence of “leading state” could provide a strategic opportunity for China to deeply involve in the reform and updating of global energy governance. On the whole, the economic, legal and political benefits of possible accession to ECT outweigh its costs. Therefore, China should seek to actively participate in the modernisation of Energy Charter process and actively consider signing the Energy Charter Treaty. This could help safeguard China’s interests in international energy cooperation and energy security, whilst promoting a better world energy governance system balancing the interests of both energy suppliers and consumers
