Abstract

Spanish Abstract: Numerosos críticos cuestionan la legitimidad del derecho internacional de inversiones y del arbitraje inversionista-estado, argumentando que este campo del derecho, junto con el de la solución de controversias internacionales, representan una amenaza a principios fundamentales de derecho público, como la democracia y el estado de derecho. Este artículo propone reaccionar a los retos que presenta el derecho internacional de inversiones a los valores derecho público doméstico de forma más constructiva. En lugar de demandar la reconstrucción del derecho internacional de inversiones, o incluso la abolición del arbitraje inversionista-estado para reivindicar los valores de derecho público, este capítulo recomienda el uso del razonamiento del derecho público dentro de la estructura actual del arbitraje de inversiones mismo. Con este fin, este capítulo traza las bases conceptuales y metodológicas de un nuevo enfoque de derecho público para el derecho de inversiones, que tiene el potencial de incentivar la aceptación y la legitimidad del derecho internacional de inversiones.

English Abstract: Numerous critics question the legitimacy of international investment law and investor-State arbitration, arguing that this field of law and dispute resolution presents a threat to foundational principles of domestic public law, including democracy and the rule of law. The present paper proposes to react to the challenges international investment law poses for domestic public law values in a more constructive fashion. Instead of demanding the re-crafting of international investment law, or even the abolishment of investor-State arbitration, in order to vindicate public law values, the paper recommends an expansion of public law thinking within the existing structure of investment treaty arbitration itself. To this end, it outlines the conceptual and methodological foundations of a new public law approach to international investment law, which arguably has the potential to enhance the acceptance and legitimacy of international investment law as a whole.
